TERMS AND CONDITIONS




All guests staying at CimmaronStJohn managed properties are responsible for reading, understanding and abiding by the following Rental Policies.  We are committed to making  your vacation on St. John safe and enjoyable and adherence to these policies will help to insure that your vacation will be a time of fun-filled memories of our wonderful island.  Questions or comments relating to these policies should be directed to CimmaronStJohn by  email to [email protected].

RENTAL REQUIREMENTS: The person placing the reservation must be over the age of 25 to enter into the Property Rental Agreement (“Agreement”) with CimmaronStJohn (“Agent”) and is considered to be the “Guest” at the vacation home (“Property”).  Guest will indicate on the Agreement the total number of persons staying at the Property and those persons other than the Guest will be considered to be the Guest’s invitees.  No one other than the Guest and the Guest’s invitees will occupy the Property during the term of the reservation.  All discussions with Agent regarding reservation terms, travel insurance, cancellations, damage policies, etc. will only be with the Guest and Guest shall be liable for all acts of Guest’s invitees or other persons invited onto the property by Guest. Guest may not sublet or assign the reservation.

RENTAL RATES/TAXES/FEES:  The total payment amount for the reservation includes the following:

PROPERTY RENTAL RATE:  The rate for the Property is based on the number of persons listed on the Agreement.  Rate is subject to change if the dates of the reservation change or the number of persons increases after Confirmation (see below).

HOTEL TAX:  Each rental is subject to a 12.5% U.S. Virgin Island Hotel Tax which is calculated on the Property Rental Rate.  Changes in the Hotel Tax Rate after Confirmation may result in additional amounts due prior to arrival.

DAMAGE DEPOSIT WAIVER FEE:  A non-refundable damage deposit waiver fee is included for each reservation.

CLEANING FEE:  Due to enhanced cleaning requirements due to COVID-19, an additional cleaning fee will be included for each reservation.

TRANSACTION FEE:  A service fee of 5% of the total payment is included for each reservation.

TRAVEL INSURANCE FEE: Although optional, travel insurance is highly recommended to cover unforeseen events leading to cancellation of a reservation in whole or in part.

RENTAL CONFIRMATION AND PAYMENTS:  Agent will place the Property on a 48-hour HOLD prior to confirming Guest’s reservation.  At the expiration of 48 hours, if payment of the 50% Advance Deposit (or the Full Amount if less than sixty (60) days prior to check-in), has not been received the reservation will not be confirmed and the HOLD will be released.  Confirmation of Guest’s reservation occurs upon Agent’s receipt of Guest’s first payment (advance or full), together with a completed and signed Agreement acknowledging Guest’s review and acceptance of these Terms & Conditions and the Cancellation Policy.  Agent accepts e-checks, MasterCard, Visa, and Discover.  If the 50% Advance Payment is made by credit card, unless Guest makes arrangements with Agent in advance, the same card will automatically be charged for the Remaining Balance sixty (60) days prior to the reservation start date.  No grace period will apply for payment of the Remaining Balance and failure to make the payment on a timely basis will make the reservation subject to automatic cancellation.  THE CREDIT CARD SUPPLIED AT THE TIME OF RESERVATION WILL ONLY BE HELD FOR PAYMENT OF THE REMAINING BALANCE OR FOR ADDITIONAL FEES INCURRED AND OTHER CHARGES AUTHORIZED BY CARDHOLDER.

CHANGE IN NUMBER OF GUESTS/CONDUCT OF GUESTS:  The occupancy at the Property is limited to the number of persons indicated in the Agreement. Guest must notify Agent in advance of arrival if the number of guests in the party has increased and pay any additional amounts due. Upon arrival, should there be additional guests in the party, Guest will be required to pay all additional amounts prior to occupying the Property.  No refunds are given for fewer guests after Confirmation. If there is excessive noise or music, any illegal activity, or evidence of violation of these Terms & Conditions, Guest and Guest’s invitees may be asked to vacate the Property without any refund and additional charges may be assessed.

CHECK IN / CHECK OUT:  Check in time is at 3:00 pm or after on date of arrival.  Check out time is 10:00 am or before on date of departure.  There is no deviation from this policy unless approved by Agent in advance of arrival or departure.

DAMAGE DEPOSIT WAIVER FEE:  Agent requires a Damage Deposit Waiver Fee (“Waiver Fee”) which covers accidental, unintentional damages to the Property that may occur during Guest’s stay up to the limits of coverage indicated at booking.  For damages to be covered by the Waiver Fee, they must be disclosed by Guest to Agent prior to check-out.  The Waiver Fee will cover the cost of repair or replacement for damages reported up to the maximum Waiver Fee coverage limit.  The Waiver Fee does not cover any damages that exceed the Waiver Fee coverage limit, any lost or damaged personal property of Guest or Guest’s invitees, nor any of the Additional Fees listed in these Terms & Conditions. If any costs or fees are incurred, including attorney’s fees, which are not covered by or are beyond the Waiver Fee coverage, Guest agrees to authorize Agent to charge the Guest credit card on file for the additional costs

CANCELLATION AND REFUNDS: If Guest should have to cancel the reservation following Confirmation, Guest must notify Agent immediately.   Cancellation of reservation at any time after Confirmation has been issued will result in forfeiture of all amounts paid per Agent’s Cancellation Policy.  Any applicable cancellation fees may be avoided if Guest purchases Travel Insurance.  Agent strives to accurately represent its vacation rental properties in all marketing media.  If Guest is disappointed or unsatisfied with the Property due to differences in taste for any reason (including decor, layout, amenities, or location) and declines to stay at the Property, this will be considered a cancellation and no refund will be issued.  In addition, Guest arrivals after the check-in date, departures prior to the check-out date, and reduction in number of guests do not entitle Guest to a rate adjustment or refund.

HURRICANE/STORM POLICY:  The hurricane season officially runs from June 1st through November 30th.    Agent will make every effort to keep Guest advised on weather forecasts and provide its recommendations on delaying arrival to or early departure from St. John before the local government closes the ports and eliminates the option of leaving. Agent highly recommends that Guest purchase Travel Insurance if planning to vacation on St. John during hurricane season.  If a hurricane or tropical storm interrupts Guest’s travel arrangements, Agent is not responsible for costs of airline changes, alternate accommodations, or refunds of payments received for Guest’s reservation.

TRAVEL INSURANCE:  For all reservations, to protect against cancellations caused by certain unforeseen events, such as illness, death and natural disasters, as well as travel delays, baggage delays, rental vehicle damage, emergency/medical expenses, etc., Agent strongly recommends that Guest purchase Travel Insurance.  Click HERE for full details on the Rental Guardian Travel Insurance products offered by Agent.

CONDITION OF PROPERTY:  The Property is furnished, equipped, and thoroughly cleaned prior to Guest check-in.  Bed linens, bath and beach towels, beach chairs, coolers, kitchenware, laundry and bath soap, limited cleaning supplies and paper goods are supplied.  Only beach towels, beach chairs and coolers may be removed from the Property for visits to the beach and must be returned to the Property after each use. Please do not rearrange the furniture.  Other than normal wear and tear and laundering of bed and bath linens, Guest shall be responsible for leaving the Property in the same condition as found at arrival.

EMERGENCIES AND SERVICE INTERRUPTIONS: Agent strives to make Guest’s stay worry-free.  In the event of an emergency or maintenance problem during their stay, it is the Guest’s responsibility to immediately contact the Agent’s office at the numbers provided for normal or  after hours assistance.  Agent is not responsible for failures of island utility service providers, including satellite/cable TV, internet, electric, or telephone over which it has no control, nor for mechanical failures, including, but not limited to, air conditioning, pool, hot tub, and appliances during Guest’s stay.  Agent will make every effort to expedite any necessary repairs, but no refund or rate adjustment will be given for unforeseen failures/interruptions of services or systems.

ENTRY INTO PROPERTY:  Agent’s maintenance staff, housekeeping staff, or other service personnel may enter the Property at reasonable times to perform any necessary repairs and will make every effort to provide service with minimum disturbance to the Guest.  If the Property is listed for sale, Agent will contact the Guest to schedule any showing(s) at a time convenient to the Guest.

SAFETY AND SECURITY:   Guest will be given keys or a keypad code to the Property and will be solely responsible for securing the Property and for the safeguarding of their personal property. Guest shall close and lock all doors and windows when away from the Property. Guest will be given a key or a combination code for the safe at the Property.  Neither Agent nor the owners of the Property are responsible for the loss of personal belongings of the Guest.

CONSERVATION:  Water is precious on St. John and electricity costs are very high.  Guest and Guest’s invitees agree to be conservative in the use of water and to report any leaky plumbing or ‘running’ toilets to Agent immediately.  Guest and Guest’s invitees further agree to turn air conditioners off when out of the rooms, when doors/windows are open, or when away from the Property.

DRUGS AND HAZARDOUS MATERIALS:  Guest and Guest’s invitees are not permitted to bring illegal substances or hazardous materials to the Property.  Any evidence of these materials at the Property during Guest’s stay will result in the need for Guest and Guest’s invitees to vacate the Property without any refund, as well as payment of any fines or costs incurred.

WEDDINGS, PARTIES, EVENTS AND QUIET ENJOYMENT:  Parties or functions are not allowed at the Property without the prior WRITTEN permission of Agent.  Guest is advised that noise travels easily and that it is important to be respectful of others at all times.   There is a noise curfew beginning at 10:00 pm in all residential areas on St. John and Guest and Guest’s invitees are expected to comply with this law.  Any violations of this policy may result in the need for Guest and Guest’s invitees to vacate the Property without any refund, as well as payment of any fines or costs incurred.

ADDITIONAL FEES:  The following additional fees may be incurred by Guests and are NOT covered by the Waiver Fee: 

ARRIVALS:  Agent provides one complimentary arrival greet for Guest which includes meeting at the dock on St. John and escorting Guest to the Property.  Guest may schedule additional greets, if needed, for a fee of $60 for each additional greet.

HOLDOVER:  If Guest stays at the Property after the 10:00 am check-out time without permission in advance, Agent is authorized to remove Guest’s and Guest’s invitees personal belongs from the Property for which Guest will incur a minimum $50 fee.

KEYS:  Guest will incur a fee of $75 for lost Property keys and $100 minimum fee (more if locksmith required) for lost safe keys.

LOST AND FOUND:  Agent will attempt to locate any items that Guest reports as being left behind as soon as possible after Guest’s notification.  Guest will incur a minimum $25 fee, plus postage, for returning items by U.S. Priority Mail.

​MAID SERVICE:  If Guest’s stay meets or exceeds the minimum stay requirement there is no charge to Guest for the arrival and departure cleans. If Guest’s stay is for less than the minimum stay requirement, cleaning fees will be included in the Rental Amount.  Prior to arrival, Agent will advise Guest if complimentary mid-stay cleaning service is provided at the Property.  If complimentary mid-stay cleaning service is not provided at the Property or additional maid service is requested, Guest must schedule with Agent in advance and pay for the service at the rate of $25 per hour with a 3 hour per-day minimum.

PETS:  Pets are not allowed.  If a pet or evidence of a pet is found on the Property, a fee of $100 will be incurred along with the immediate removal of the pet and/or eviction of the Guest along with forfeit of rental payments.

PLUMBING: The Property septic system is sensitive, but limiting the amount of toilet paper used and not flushing feminine products will help prevent a clog and keep the septic system running properly. If maintenance is called to unclog toilet paper or feminine products in a toilet, a minimum $50 fee will be incurred.

SMOKING:  Smoking is not permitted inside the Property.  If smoking inside the Property is detected or cigarette butts are found on the patios, decks, or grounds following Guest departure, Guest will incur a fee of $250 fee (plus additional housekeeping fees, as required).

TELEPHONE CALLS:  All local calls (St. John, St. Thomas and St. Croix) are free on the Property phone.  A calling card (available in local markets) must be used for long distance calls on the Property phone or Guest will be charged for long distance fees incurred.   Some major cell phone providers offer service on St. John although service may be spotty in some locations around the island.  Agent does not guarantee that cell phone service will work at all locations on the island nor that roaming charges will not be incurred.  Guest should contact their service provider prior to arrival to determine if service is available in the US Virgin Islands and if roaming charges will apply.

TRASH REMOVAL:  There is no curbside trash collection service on St. John.  Trash is disposed of in dumpsters located along the roadways.  Unless instructed otherwise by their greeter, Guest is expected to remove trash from the Property regularly and deposit it in a roadside dumpster.   A fee of not less than $50 will be charged if removal of excessive trash from the Property is required following Guest departure.

ASSUMPTION OF RISK:   Various activities while staying at the Property and vacationing on St. John include inherent risks to person and property.  Diving or jumping into a pool or Jacuzzi may result in head, neck, or spinal injuries or drowning, swimming in the ocean or other water activities such as scuba diving, snorkeling, deep-sea fishing, boating, surfing, or boogie boarding may cause injury or drowning.  Slip and fall on hiking trails may cause injury. Guest and Guest’s invitees may also encounter the following risks: slippery floors and stairs, especially when wet, decks/balconies with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, non-fenced pools, gas BBQ grills, clean/clear sliding glass doors, and uneven stair steps or pathways.  This list is not all-inclusive, but indicates some of the hazards which may be found.  Guest and Guest’s invitees agree that they are voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assume all risk of injury, illness, damage or loss to person and property that might occur, including, without limitation, any loss or theft of personal property.

LIABILITY/INDEMNIFICATION/HOLD HARMLESS: Agent and the owner of the Property are not liable for loss, damage of property, or injury to Guest or Guest’s invitees during Guest’s stay on the Property.  Guest agrees (1) to release, waive, discharge and covenant not to sue Agent and the owner of the Property, their officers, staff, agents, employees, or assigns for any liability, claim and/or cause of action, including cost of defense, arising out of or related to any loss, damage or injury, including death, that may be sustained by Guest, Guest’s invitees, or to any property belonging to Guest or Guest’s invitees arising out of use of the Property; (2) Guest and Guest’s invitees agree to indemnify and hold harmless Agent and the owner of the Property, their officers, staff, agents, employees, or assigns from and against all claims, suits, damages, costs, losses, and expenses arising from injury to any person or property occurring on or about the Property.

ERRORS/OMISSIONS: The information provided on Agent’s websites is constantly updated for accuracy. Property details are subject to change without notice.

WRITTEN EXCEPTIONS:  Any exceptions to the terms of the Agreement and these Terms & Conditions must be approved by Agent in writing in advance.

BINDING EFFECT:  The terms of the Agreement, these Terms & Conditions, and the Cancellation Policy become binding upon the parties upon Agent’s receipt of Guest’s signed Agreement and initial payment.
